Blog 6



#1 Child Abuse
1. I consider child abuse as the mistreatment of a child that can lead to safety issues, health issues including death. It is serious physical, emotional or sexual abuse, neglect, or abandonment.
2. No, I don’t think spanking is child abuse. The culture I was raised in, it was acceptable. It was never look on as wrong but a rightful discipline. There are other people out there who take it to the extreme, where they spank or whoop the child till the child bleeds proclaiming it was right from their point of view or the bible said so, which will be taking completely out of context. That situation is no longer discipline but have cross the line to child abuse.
                A. No. What I think is that neither the government nor the state should try to specifically classify it as allowed or un-allowed because, like I said before, to some it’s culture-base. We all know right from wrong, we all have morals, we all had parents. Surely we can identify what is and what is not abuse; from the ones that never been abused to the ones that had. They could very well identify that there’s something wrong. Every word that comes out of a child mouth should not be taking lightly, every child that has an emotional change, of happy to sad, should not be passed without consideration. There’s a fine line between discipline and child abuse. 
3. Punishment should be a public concern when a person is frequently chastening the child, frequently threatening the child of punishment, seemingly not aware of the child presence.  There’s a time when we need to speak up, when we need to step in and intervene, because it no longer rest on the idea that we’re telling you how to raise your child but the fact that the child is a human being without the full knowledge or comprehension necessary yet to be judge or ridicule in such a manner.
                1. There are not certain acts I feel that it’s acceptable punishment because all of them can be taking to the extreme. But slap on the hand
                2. Unacceptable act can be the vigorous pulling, shaking of the child, hitting the child with excessive force. I think people in our society feels and know when there’s something wrong but they usually dismiss the feeling, or the thought, and keep on with their lives. That is what we have to change.
#2 Sexual victimization
4.       Arkansas’s child pornography law is any person that persuades, employs, uses, entice or coerce a child to engage in visual or print medium that is sexually explicit also any person that knowingly produce, direct and promote child pornography. They can face up to 30 years sentencing.
Knowingly involve in the distribution of child pornography or possession of a child engaging in sexual act face up to 10 years.
All of these are felonies followed by being place in the sex offender registry. Class C for first offenders and Class B for subsequent offenders.
If a person fail to report computer child pornography is Class A misdemeanor

5. Sexting
A. Sexting, in Arkansas, is not classify separately. It is still child pornography, therefore the same punishment.  It is a felony, it is 10 years of prison if knowing advertise, distribute, display or receive with intent to sell and 30 years if coerce child to be involve. If found guilty than individual will have to be register in sex offender registry.
                B. Sexting is the sending of sexually implicit pictures of someone through mobile.
                C. Yes, I think it should be punished. For the offender, it is still distribution of child pornography if the victim is under 17. I don’t think they should be punished severely, because sexting usually happens between the young, but they should be fined heavily and be subjected to community service for first time offenders. For the victim, if the individual was not drunk and didn’t know the picture was taking than they should be let off with warning and be giving better life decision skills.
6. In Malvern, Arkansas Tom Buck Steele, 60, was found guilty of child pornography. He is sentence to 164 years in prison along with a fine of $56,000. He was charged on 20 counts; he’s serving 10 years on two counts and 8 years on 18 counts. He has been under investigation since 2011. When they did search his place they found computers containing many pictures of child pornography. For the trial he pleaded not guilty but, after a two day trial, on March 28 of this year, the jurors found him guilty.
7. Child victimization is different because it involves children. Children are usually the ones that are less heard. Even when they speak up, no one listen, because they’re young and everyone seems to have the idea that they don’t know any better.
8. Fallen angels (1981) is about a young girl who develop a relationship with this man who I older than her. The man is a pedophile and he promises her that she will be a ‘start’. He soon persuaded her to start posing for him with each time making her reveal more and more.
John Shearen is considered the number one child porn distributor by police in state history.  He was just recently been arrested in Leesburg, Florida and police found close to about a 1 million images and videos of child . As of right now he’s charge with 15 counts but the police department wants to add more.

Blog 5- Murder



1) Homicide is the killing of another being or the act of it. It is knowingly, purposely, recklessly, or negligently cause the death of another. Homicide can be classified into two classes; criminal or non-criminal homicide, where non-criminal homicide can be further divided as justifiable or excusable homicide. Justifiable homicide is noncriminal and proper under law. It is self-defense or the killing by officers, soldiers, those types of people. Excusable homicide can be insanity, intoxication, extreme youth, or psychotic. Murder is not far off from homicide, in fact it is part of homicide, it is criminal homicide. Murder is not only the killing of another human being but that intent or the premeditation to kill. It is mala in se, wrong in itself, and is unlawful. There is 1st degree, 2nd degree, 3rd degree or manslaughter.

2) A father is charge with the murder of his two sons. His first son, Travis Fox II, 6 months old a year ago, was taking to hospital due to injuries, where he later died. Travis Fox was a suspect in the death but yet was allowed to go back home to his family where he supposedly strike again by admitting  he killed his 7 months old baby boy, William, three weeks ago and in the process admit he killed his first born son. He proclaimed that during both murders he was drunk, angered, and tired. He was ask to show how he shook the baby and from how he demonstrate it law officials stated that it was a violent shake. He is charged with 1st degree murder on two counts. Under Arkansas law he knowingly cause the death of another, victim was under the age of 14 and he show no value to human life.  His arraignment will be held on April 17th. The only type of media that talk about this is news networks which gave facts more so than opinions. But any killing of a child will be sensationalized and the offender is looked through the most negative light.  The neighbors though of this couple were shock to hear the father, Travis Fox, killed his sons. He is also charged for breaking his five year probation of previous theft-related crimes.

3) "Mr. Brooks" is a movie about a serial killer. He has been killing for quite a long time and has murdered many people but had never gotten caught nor did he get caught in the movie. But there is no doubt if he did he would be charged with murder in the first degree with multiple counts.

The music "Man Down" by Rihanna portrayed the murder of a man by a young lady that has been sexually assaulted by that man. This constitutes murder because in the video she didn’t kill him on the spot but went back home, got a gun, went to the place he was at and shot him. All that shows she knew right from wrong and had the intent to kill.

Mob Violence



 1.Mob violence is a disturbance of peace to commit unlawful acts. It comprise of a group of unorganized, emotional people that has past their trigger point and lashed out and. Examples are racial mob, religious riots. It exist because they usually have a message they want to convey. To let the government know that the people of its government have issues that is not being heard or nothing is being done and a change must be made.

2. This riot was the most famous of riots in Arkansas because it held many values and signifies many important marks of that era, it was called the “Elaine Massacre” “ Elaine Race Massacre” or “Elaine Race Riot of 1919”. It was the first time federal court got involved against a racial biased southern court and as well as reversed the decision made by them by later released black folks that were held prisoners. The riot caused the lives of two hundred African American, and many others were later forcibly arrested. What caused all this was the fact that many of the African American felt they were being underpaid by their white landowners and the price of cotton that they made were undervalued. So they set up a union and during the union white officials came and reportedly fired at the crowd, though many don’t really know who fired first, the union fired back and killed two of the officials. After this the whites were hell-bent in destroying and burning blacks homes and businesses. Since this happen a while ago media coverage is hard to find but one story that ran in the NY Times stated it was all planned by the black community to massacre whites that day.

3. 
-Music video “No Church In The Wild” by Jay Z and Kanye West featured riots, it involve rioters against the police. It’s a mass of police trying to control a whole bunch of people that have cause chaos, wreckage, and destroyed the city.
-A riot broke over a brand new Nike shoe that was release that day. The crowd was told to stay back when one person ran toward the store and the rest follows. This happened in the Orlando Florida Mall of last year.

Blog 3- Sexual Assuault/Rape in Arkansas

1)Population of Arkansas is 2,937,979. The total number of reported forcible rape is 1,213 (reported and estimated) including non-metropolitan, metropolitan , and cities outside that area. Metropolitan reported 851, non-metropolitan is 14, and cities outside metropolitan, 32.


2a) Arkansas Statute of Limitation is six years for rape (class Y), knowingly transmitting a disease (class A), sexual assault 1st degree (class A), and transportation of minors for prohibited sexual conduct (class A). It is then cut down to 3 years on sexual assault 2nd, 3rd, 4th degree, Incest, and most offenses that involves children. Misdemeanors and violations are one year. Statute for limitation cannot be extended for more than 3 years if the accused is continually absent from the state or has no reasonable ascertainable place to live, stay or work within the state, and also if the accused has an ongoing charge for the same conduct. If an offense took place in the office by a public servant 5-10 years after leaving office or of it being discovered it still can be commenced by the prosecution. DNA also comes into question for rape, because in the face of DNA statute of limitation no longer holds and is eliminated once DNA forensic and other information emerged against the defendant or someone in the system as evidence based on advanced in technology.

2b) Both rape and sexual assault are classified as sexual offenses and are felonies. They basically hold the same meaning the only difference lie in the age of victim and offender. Rape is a person that engages in sexual intercourse or deviate sexual activity with another person; forcibly, with another that cannot consent, with a minor and the offender is the minor’s guardian or is related to the minor. The age requirements is less than 14 years of age and the defendant is more than 3 years older. There is sexual assault in 1st, 2nd, 3rd, 4th degree.  First degree is, for the most part, same thing as rape but extended to include the victim is not the victim’s spouse and the offender is someone that holds a position; employee in Arkansas Department of Correction, teacher, or is in a position of trust or authority and the offender is not more than 3 years older than victim. Second degree is someone 18 years or older engage with someone under 14 or 12 years old and involves sexual contact. Fourth degree is with someone under 16 years of age and offender is at least 20 years old. Both 3rd and 4th degree involves intercourse and deviate sexual activity, while 4th degree adds sexual contact.

3) Six year old Jersey Bridgeman was found dead in an empty house November 20, 2012 not far from where she lives in Bentonville, Arkansas. The person who is charged with her death is her babysitter, Zachary Holly, 28. He is charged with rape, kidnapping, and burglary, and capital murder. In his arraignment last month he pleads not guilty and is scheduled for a pretrial on Feb. 28. The night before Jersey's body was found he was with her, babysitting her along with his wife Amanda Holly. On that night it was Zachary who took Jersey back to her house and placed her on her bed after the mother, DesaRae Bridgeman, came to pick her and her sister as well.  Less than a year ago the father and stepmother of Jersey Bridgeman, David and Jana Bridgeman are serving 18-year and 12-year sentence, respectively, of chaining the same little girl to a dresser. Right now Holly is in county jail and the semen found on Jersey’s body was taken to a lab. No result has been mentioned on whether it’s a match to a cheek-swab test of Zachary Holly.

4) The Invisible War (2013), A new movie that just came out last year taking aim at military sexual assaults. A different angle than most dare to speak of, an issue that has been feared of bringing into light. It is based on interviews by those who have been sexually assaulted and rape, and point of views of plaintiffs. It paints a picture of the lack of attention that goes into this subject by those who are in authority to do something about it, but yet has been hard to issue forth investigation when the victims come forth. It is not only on women but on men. Sixty five thousand sought treatment and men accounts for 40%.  This movie is no doubt is accurate of rape/sexual assault military-wise, giving facts and real life statements from victims themselves.

The song by Angel Haze “Cleaning Out my Closest”.  It’s a personal account about how this rapper was sexually abused and assaulted when she was young and because of that she is psychologically messed up. The person she’s referring to in this song, her abuser, seems to be just one of many that was “successful” in sexually assaulting her around the age of seven, if not younger. In one line she states that the abuser would tell his friends and they will join, and in another situation everyone knew what was going on but said nothing. This song paints a good picture of what sexually assaulted victims go through, especially if they are a child. The words of a child over the word of an adult don’t seem to stand a chance. They themselves do not know what to do but to cooperate with their abuser while at the same time all their emotions are piling up inside until that forever messed up their childhood and adulthood.

Blog 1


     The ending to this story: A young woman found shot dead in the head by her boyfriend. The twisted thing about this is that there has been three previous charges filed against him, all involve a no-contact, and each time he broke them all. The police seem to do nothing but  give him bail to pay until December 31st, 2012 he finally put a bullet through her head at her apartment after beating her badly, which seem to solve the  problem for the police and his. Victor Acuna-Sanchez, age 18, the father of Laura Acavez's, age 21, 5-months old baby, was previously charge with aggravated assault, third degree battery along with two other alleged attacks. Their 2-year relationship was nothing but abused; beating her with a baseball bat, beating her while she was seven months pregnant, rob her, strangled her, dragged her behind a car. Courts record show attacks in the course of a year but only three arrest were made. The third time that he was arrested, December 9, the Judge found it fit to let him out on his own recognizance, with no bail; and that was three weeks before he killed her. Police claim they did not know. Right now he is behind bars waiting arraignment on February 11th to see if prosecutors will charge him with death penalty or life imprisonment without parole. The gun found at his apartment, .22 caliber, is link to the rounds found at the victims apartment.

#1. Domestic violence in Arkansas is define as a pattern of abusive behavior that takes place in a relationship by a family member, someone in the household, or someone the abuser had dated recently. It is done in order to gain power and control in the relationship. Domestic violence does not only constitute physical abuse, but includes sexual, emotional, economic, psychological abuse. Sexual conduct between a family members such as with a child is a crime in Arkansas. I don't believe it's a felony, but it has the potential to be a misdemeanor if the abuser violate an Order of Protection that was set against him/her.

#2. In Arkansas an if you are abused you can file an Order of Protection, as stated above, this provides a restrain, issuing the abuser to stay away from residence, school, business place, or your child's school. There is also Arkansas Coalition Against Domestic Violence that provides shelters throughout Arkansas that the abused can go to (you can find your local shelter). It gives them information of domestic violence, help support programs for battered woman.  Arkansas Legal Services Partnerships are there for the ones who have children that have been abused and are low-income.They have a help line to help assist in legal services.

#3. The music "Love the Way You Lie" Eminem ft. Rihanna is about an abusive relationship. Both partners in the relationship are violent but the woman to a lesser extent. There's arguing, fighting, it seem like the girl wanted to leave but in the end shes right back in bed with him cause they love the way it is. The movie "Burning Bed" is about a woman who was abused for 12 yrs and one night after her husband rapes her she decided to burn him alive while he was sleeping. She went to court and verdict reached a 'not guilty' for reason of temporary insanity.
